1. Introduction

Welcome to Journal Party! These Terms of Service ("Terms") govern your access to and use of the Journal Party platform, including our website, applications, and services (collectively, the "Service"). By using Journal Party, you agree to be bound by these Terms.

Journal Party is a platform for pen and paper journalers to gather in automated chat-based sessions and write together. We provide the social layer for journaling, while the actual writing happens in your own notebook.

Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not access or use the Service.

2. Account Terms

To use certain features of the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account and use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service in any way that violates any applicable law or regulation
  • Harass, abuse, or harm another person, or engage in bullying behavior
  • Share content that is defamatory, obscene, or otherwise objectionable
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service

We reserve the right to suspend or terminate your account if you violate these terms or engage in behavior that we determine, in our sole discretion, is harmful to other users or to Journal Party.

4. Content Ownership

Your Content: You retain ownership of any content you create, upload, or share through the Service ("User Content"). By sharing User Content, you grant Journal Party a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of operating and improving the Service.

Journal Party Content: The Service and its original content (excluding User Content), features, and functionality are owned by Journal Party and are protected by international copyright, trademark, and other intellectual property laws.

Program Content: Programs, prompts, and other structured content created by Journal Party or premium creators remain the intellectual property of their respective creators. You may use such content for personal journaling purposes but may not redistribute, sell, or commercially exploit it without permission.

5. Payment Terms

Journal Party offers both free and premium subscription plans. Premium features require a paid subscription.

Billing: Payments are processed securely through our payment partners (including Stripe and PayPal). By subscribing to a premium plan, you authorize us to charge your selected payment method on a recurring basis until you cancel.

Pricing: Subscription prices are listed on our pricing page. We reserve the right to change prices with 30 days' notice. Price changes will not affect your current billing cycle.

Refunds: Subscriptions are generally non-refundable. However, if you are unsatisfied, please contact us within 7 days of your initial purchase to discuss your options.

Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period.

6. Termination

By You: You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service will immediately cease.

By Us: We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, we may delete your account and associated data, subject to our Privacy Policy and any legal retention requirements.

7. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. JOURNAL PARTY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy or completeness of any information on the Service.

Journal Party is not a substitute for professional mental health services. If you are experiencing a mental health crisis, please contact a qualified professional or emergency services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JOURNAL PARTY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Service prior to the changes becoming effective.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
